DES MOINES (AP) - Herman Bauer of near Dedham has filed suit in Polk County District Court seeking amounts ranging from $10,000 to $35,000 on seven different counts. Defendants are Stern Finance Co. of Des Moines, and Ben Stern, its president.A total of $230,849 is asked in the seven-part suit, although it was pointed out that some claims may be duplications.The action involves purchaseof cattle by Bauer from Boss Dairy Sales of Carroll on Dec. 20, 1962, and from Boss and other parties at later dates through promissory notes assigned to Stern Finance Co.The petition contends the defendants failed to release encumbrances of record in the Carroll County recorder’s office after the previous balances due had purportedly been incorporated into new balances.It also accused the defendants of having Bauer shadowed and making demeaning, insulting and embarassing remarks about him.The petition claims the finance company and Stern contrived to repossess property forsome real or alleged defaultafter a substantial amount hadbeen paid and with selling 40repossessed cattle drastically below fair market value.Bauer says that as a result ofthe defendants’ action he losthis dairy herd and dairy cattlebusiness.
