Pair held for courtTwo Franklin men have been bound over to the next term of Venango County Grand Jury forpossession of marijuana.The charges were approved Tuesday afternoon against Robert William I-aing Jr., 24, of 1309Me Franklin Ave. and Richard (I. Witherup, 29. of 828 Liberty St.District Justice Robert E. Billingsley approved the charges after hearing testimony from Franklin Patrolman Charles Tarr, the arresting officer.Witherup failed to appear for his hearing. Billingsley explained that under the new crime code this would be the same as waiving a hearing and the case going right into county court.Laing and Witherup were arrested by city police near the West Park July 6.Patrolman Tarr testified he observed the pair in and near the city park for over an hour before he made the arrests. He said they were watched from a building across the street.Tarr explained that the two men were passing a cigarette between them. He added he saw Witherup with a clear plasticbag and cigarette papers. (When the two men were approached they were in Icing's truck on West Park St. Patrolman Tarr said I^ing allowed him to search the truck and volunteered that the marijuana was in the glove compartment of the truck.Tarr testified that he con- | ducted a field test and the substance found in the plastic | bag was marijuana. He added , that the marijuana has been , sent to the state police crime lab in Erie for further tests and(processing. .Both defendants are free on 1 $500 bonds. lt;
