Neil Shannon of Headquarters Intelligence pivision, State Police, was shot through the chest with a rifle. He was brought to a hospital here where it was said that his recovery is mprobable.The slain man was identified as W.‘ H. Bybee, 2G, who escaped from the Huntsville (Tex.) prison, farm with 18 other convicts June 22.Sergt. Buck Mooney riddled Bybee with a machine gun after the convict shot Shannon. Mooney also shot a pistol from the hand of another escaped Texas convict, James Rice, 30, who then sur-rendered.Third Fugitive FleesA third Texas convict, Harry Roberts, 34, fled on toot through the woods during the gun battle. Other members of a posse headed by the State Police pursued Roberts.Lieut. Earl Scroggin of State Police headquarters said Rice escaped from the Texas prison June 15, 1936. He was serving a 27-year sentence on two robbery charges. The' officer said Roberts escaped with By bee June 22. Roberts was serving a life sentence for robbery with firearms.First Sighted at Selma z Sheriff W. C. Cruce organized a posse of 10 officers yesterday afternoon to ■ hunt ,lt; the three men, believed to be the/same who robbed the Bank' of Weiner in eastern Arkansas recently. ■ They appeared at nearby Selma where they obtained, gasoline /’ and J groceries.*1 They were, traveling in on automobile which officers reported fitted the'description of the getaway car used in the Weiner robbery.Fugitives Open Fire Shannon and Moody were rushing ahead of the other members of the posse when they came upon the hidden machine in which the three men were crouched, guns ready. The fugitives opened fire.When the other officers reached the scene, the man identified as Bybee was slumped bade in the car, his head riddled with bullets. Shannon was bleeding from a chest wound and Mooney had the man identified as Rice under arrest.Rice and Mooney were unscathed.The other officers immediatelytook up the trail of the third man.Were Elusive Trio *7e | The trio eluded officers last Friday near McGehee after they. stole an automobile at Fordycem and disarmed a deputy sheriff atRison in their flight.
