By Kerry Haglund The AmericanA 39-year-old man accused of three counts of attempted capital murder in an April shootout that wounded an Ector County sheriff’s deputy will be tried on the charges this week.Jury selection in the trial of Terry Phillip Walls, 4045 Cypress Road, began at 9 a.m. today in 70th District Judge Gene Ater’s court.Court-appointed defense attorney Jim Jordan entered a motion for continuance Thursday because Dr. Richard E. Coons, an Austin psychiatrist who examined Walls, is unavailable to testify.Ater did not sign the motion, however.During a July 6 pre-trial, Jordan withdrew his notice of his intent to raise an insanity defense and sought to reduce Walls* bond from the current $150,000 to about $30,000. Ater deniedthe motto.To be free, Walls —* jailed since his April 29 arrest — is required to post 10 percent or $30,000 of the three $50,000 bonds set on three attempted capital murder charges. Jordan sought to lower that amount to $3,000.Jordan, who has filed a motion to suppress Walls’ statement to authorities, has alleged that hospital officials refused to remove a bullet lodged in Walls* right shoulder because he was too intoxicated for doctors to safely administer anesthesia. On that basis, Jordan maintains that his client wastoo intoxicated to give the statementdeputies obtained from him that same night.Jordan also has claimed Walls was too intoxicated to know of his right to counsel during the taking of the first statement and was promised counsel when a second statement was taken, but never received it.Sheriff Capt. Gene Kloss has said the defendant never requested a lawyer.Walls was arrested after an April shoot-out ir which Deputy Carl Rogers sustained head wounds from a round of buckshot that shattered his patrol car’s windshield. He was held overnight at Medical Center Hospital.After being wounded, Rogers fired two shots —■ one that hit Walls, according to sheriff’s reports
