It* was not learned who will lace the second charge.Little Rock, July 19.-MP)-Frank Martin, the trusty convict guard serving a 21-year sentence for second degree murder, who shot Helen Spence Eaton, escaped girl convict, to death, appeared as a witness today before the grand jury that has been asked to indict him for first degree murder for the killing.Next to the last witness, Martin was expected to tell the grand jury he acted under orders when he fired his shotgun at the 22-year old brunette slayer as, he claims, she attempted to draw a gun from her blouse. His attorneys indicated that would be his explanation of theshooting of the girl he was sent out to capture. The Eaton girl was killed on a lonely country road a week ago about nine miles from the Jacksonville women’s prison from which she had made her fifth escape 24 hours earlier.Martin was questioned for 45 minutes, the longest of any of the score or more of witnesses that testified in the two day investigation.
