Shortly after 3 a.m. that night Mrs. Hofmeister’s pickup was discovered. TTie emergency flasher lights on the vehicle were on at the time and when deputies arrived the body of Mrs. Hofmeister was discovered. The time of her death was placed at approximately 1 a.m.Then Bonner County prosecuting attorney, Dan Feathcrston, began an immediate in-, vestigation into the hqmicide, but in early September requested an outside prosecutor to take over the investigation. Featherston said at the time that, Due to my personal association with the family of the decedent I feel that an outside prosecutor would be more able to objectively carry the case through.Featherston also noted at that time that he believed the investigation would take no more than five to six more weeks. However, it took a month of haggling between Featherston, then Idaho Attorney General Tony Park and First District Judge Dar Cogswell beforeBoise Attorney Thomas Frost was appointed Special Prosecutor in the Hofmeister case.Park declined a court order issued by Cogswell to appoint a special .prosecutor in the case, but later agreed to pay half the costs of hiring the special prosecutor, or $3,000, whichever was the lesser amount.Once Frost was appointed, he spent some time reviewing the evidence in the case before conducting his own investigation that culminated in a request in March of this year for a grand jury to hear evidence in the case. Frost said at the time that he asked for the call of a grand jury because of its subpoena powers and ability to receive sworn testimony.Frost said today that a number of witnesses appeared before the grand jury, but declined to comment on how many, or whether any had been subpoenaed.However, Coeur d'Alene attorney Tomas A. Mitchell, who had been retained by Hofmeister in the case, wrote in a letter to Daily Bee Publisher Pete Thompson this week that only one witness had been subpoenaed by the grand jury. That witness was Howard Scott, said Mitchell.
