From the testimonygiven before the magistrate, it appears * that on the tenth day of la^f MarchRichard Harris,! a colored man, who lives near Greenfield Mills, lost a black t I heifer which strayed from his fields and» in some way got lost. Nothing was e heard of it for some time. On t he foi-y I lowing day a stray blank heifer wander ed past Mr. Arch Snonifer’s farm and got in with a bunch of cattle on the farm of Mr. Edward Hummer, which adjoins the farms of Mr. M K. Harwood and Mr. Arch Snootier, all three farms being situated between Vdains town and Greenheld.Mr Plummer advertised the cow andsome tune later it was claimed bv Mr Harwood a* his property Harris heard 1)1 I that the heifer was at Mr Harwood's, !I I and went to Harwood's and claimed it Later he secured a writ of replevin to recover the heifer and the trial yesterday was to prove the ownership of theanimal. Richard Harris and his two sens, Ii* k and (Jus, and the wife of thelatter all swore positively that the heifer was the property ef Richard liar rin and gave a description of the animal. On the other hand, Charles mid Augustus Proctor and William Hallman, three colored men who work for Mr Hat wood, and the defendant, Mr Harwood, all swore with equal po»itiveue«s that tho heifer was the property of Mr. liar wood. Mr. Kemp Buokey, upon whose farm Harris lived when the heifer was calved, swore that the heifer in quosfciou was the property of Harris and identified it by certain marks which he had seen and remembered.in ihe opinion of Justice Eckstein the preponderance of the testimony proved that the heifer was the property of Harris and thia morning he rendered a judgment in his favor.The appraisers valued the heifer at $J2. The cost of tho suit will amount to about f'-h). J.
