When about 17 years of ace, or in the year j 1S55, he went to Illinois, and there engaged in horse stealing. Being hotly pursued by the Sheriff of we think) Bureau county, voting Kirk shot that officer and made good his escape. Karlv in 1S57 he made his appearance in Sonora, California, as an awkward looking, overgrown boy. He divided his time between drinking and gambling saloons, fundanco houses, ami j other resorts ot the vicious, and soon developed an ambition to become a tighter or desperado. He took to robbery, was caught at it. and imprisoned in the County Jail. John Sedgwick was elected Sheriff of Tuolumne county a short time before young Kirk was imprisoned, and taking compassion on the boy made a ••trusty” of j him, allowing him bis liberty w ithin ! the precincts of the jail. After the. term of Kirk’s imprisonment expired, ; Sedgwick employed him about the' jail as errand boy and to look after the ; premises, fine night Kirk got on a spree, went up to the “Tigre,” the Mexican portion of the town, went into a billiard saloon, drew a large knife and began cutting the cusliions of the tables. The proprietor remonstrated with him and received a threat in return. The Mexican, knowing' Sedgwick and Kirk were friends, sent | for ihe oflicer. tin.king he would be' able to prevent further damage without resorting to violent means. The sheriff arrived, and. walking up to ; ward Kirk, said: **llcre. Next be turned up in Storey county, in the ear!y days ' of the Washoe excitement, and soon brought lip in the Territorial 1'rison for robbery.
