WOOD, SHERIFF.The Plaintiff, about the year 1804, became the creditor of the celebrated Mr. King, to the amount of £1700. He at length was obliged to have recourse to legal proceedings in order to obtain his money.— The Sheriff was directed to lay an execution upon Mr. King’s house in Norton-street. That officer, under an indemnity of £2000, returned nulla Bona ; it was subsequently ascertained, that there was property in the bouse, and the present action was brought to recover damages for the false return.The defence set up was, that Mr. King having been discharged, as an insolvent Debtor, his effects became vested in the Clerk of the Peace, and that he had at the time of the execution no property.On the part of the Plaintiff it was contended, that Lady Lanesborough, the wife of Mr. King, had pur-1 chased furniture previously to the discharge of her ] husband, and that the property, of which she was ; undoubtedly in possession at the time, was to be con-: sidered liable to the demands upon Mr. King.
