Death penalty action spurs bid for new trialSAN ANTONIO, Tex. (AP) -Prompted by the recent Supreme Court ruling against the death penalty, a Corpus Christi man who was sentenced todeath in the electric chair six years ago has filed a petition for a new trial.Juan Rudy Enriquez, 24, says his death penalty and conviction should be set aside on grounds that Texas law does not permit a sentence imposed by a jury to be reduced if that sentence is later found invalid.A state court jury in Karnes City convicted Enriquez and set his penalty at death in October, 1966, for the slaying of a Bee-ville, Tex., housewife during a South Texas shooting spree that left four other persons dead.Enriquez contends the recent Supreme Court ruling against the death penalty wculd require his release.He filed his petition in federal court here earlier this week by mail from the Huntsville State Prison’s Ellis Unit.
