LEGAL PYROTECHNICS MARK SYKES TRIALfContinued from page oncA___Attorney Bell proceeded to quote cases in which decisions had been rendered by the L nited States supreme court in support of his contention.Sykes on the Stand.Joshua Sykes in his examination testified that he was born in Virginia 57 years ago, and that he had resided in California for 10 years. He said that he came to Berkeley in March, 1915, after having resided in Los Angeles for 10 years. He claimed that lie had been preaching for 30 years and was formerly a Baptist minister. He has been preaching the faith of the Church of the Living God for 10 years. Sykes said^hat he and the members of his congregation called themselves “spiritual Israelites.”After a jury had been selected last evening, at the request of Attorney B. D. Marx Greene, the jury were taken to the Tabernacle of David to inspect the tents. They were conveyed to the Church of the LivingGod on Derby street, near Milvia street, in three automobiles, and were allowed to make a thorough inspection of the tents. This is the first time that any not members have been permitted to enter the private praying tent. This tent contains an elaborately ornamented rostrum and many leather upholstered benches.The Sykes case is arousing much interest and the court this morning was crowded with spectators. Among those present were a number of local ministers who closely followed the arguments of council. Sykes is appearing for the second time in the justice’s court charged with the violation of a city ordinance which prohibits the erection of a tent without a permit is granted by the city council. At the first trial Judge Edgan dismissed the case against the pastor,declaring that as Sykes had^ filed an up*-plication with the council for a permit and had received no notification that the application had been dealt with, the judge considered there weremitigating circumstances* -•Immediately the case was dismissed a further complaint was sworn out against Sykes and on being arraigned he demanded a trial by jury.
