T1u| id c fend ant had been on the stand but a few minutes when the line of examination pursued by Attorney-Theodore Bell was hotly challenged by B. D. Marx Greene, who is appearing for the people.Greene argued that the introduction of evidence as to the form of religion practiced by the defendant -was immaterial and was not admissible. Bell maintained that in order to show the ordinance was unconstitutional and that it was used in a discriminating manner against the defendant it wasnecessary to introduce the evidence.He was willing to argue the matter of law, he said, but insisted that the jury should remain while he presented his arguments to the court.“I want to show.” said Bell, ‘‘that this man came to this city and leased a certain piece of property thus be-coming a leaseholder and property-holder in this city. The property isabsolutely his so far as the enjoyment of it is concerned. He then, for the purpose of enjoying this property, not only personally^ but for carrying on religious services, erected upon the nropcrtv which he had leased the Tabernacle of David. 1 want to show that this ordinance discriminates between him and any other property holder in Berkeley and that lie is entitled to erect 011 this land, of which he is still the possessor under a full lease, any sort of structure he may sec -fit to build. He may erect anything he likes subject only to the power of regulation and that power must relate-to the use to which he puts his property and cannot prohibit the use of that property and to assert that these people cannot erect a tent or tabernacle discriminates between the defendant and other property owners.”tfCnntinnpd on natr**
