By RICK RAFAEL Star Staff WriterTALLADEGA — Alabama Atty. Gen Bill Baxley will seek indictments against State Sen. Bobby Weaver of Talladega within a month. Baxley announced Friday.Baxley said indictments will be sought on charges of misapplication of a client's funds, forgery of endorsements of checks and forgery of other legal documents.Weaver has been under investigation by Baxley s office for several weeks after a complaint; was filed with Baxley that Weaver allegedly withheld a court judgment from one of his clients.Baxley would not elaborate on other aspects of the investigation, but The Star learned several days ago that representatives of Baxley's office have checked records at the Talladega County Courthouse involving Weaver’s purchase of property and mortgaging and banking practices carried on by the senatorFriday it was learned that the Federal Bureau of Investigation has been conducting a probe of its own for several weeks Special-agent-in-ehargeHoy Kirkpatrick of Birmingham said the bureau opened a case on Weaver about two weeks ago. Kirkpatrick would not reveal details of the FBI probe, but informed sources told The Star Weaver's financial and business dealings were among those things the FBI is interested in.“We will seek numerous criminal indictments on transactions involving hundreds of thousands of dollars.” Baxley said Friday. “We will be ready to go to the grand jury within three weeks.” Baxley said a special session of the grand jury might be called to handle the state's evidence against Weaver. He said the presentation ofevidence will be handled by Deputy Atty. Gen Bill McKmght. who was responsible for obtaining indictments against former Talladega County Sheriff Luke Brewer several years ago Baxley called the complaint that prompted the investigation “the tip of the iceberg ” The probe apparently spread out statewide and involves several lending institutions from Decatur to Mobile.Weaver are on file at the Talladega County Courthouse But it also has been learned thatseveral mortgages have not been filed at the courthouse and discrepancies and errors of record have turned up in many casesTalladega County Probate Judge G. KyserLeonard confirmed Friday that he has authorizedthe locks at the courthouse records room bechanged Leonard came under fire this weekbecause of the records and said Friday he was checking into the problemsWeaver. 36. is beginning his second term in the Alabama Senate and has not been in regular attendance in the upper chamber in recent weeks, according to capitol observers.Weaver is chairman of the Senate Business and Labor Committee, vice-chairman of the Insurance Committee, a member of the Rules Committee. Constitution and Elections Committee and Agriculture CommitteeHe is a graduate of Cumberland Law School at Samford University.The 19th Senate Dist., which he represents, is composed of St, Clair County and parts of Talladega and Calhoun countiesWeaver was not available for comment
