Moklen, Detective John Harrison and OfficerLewis Hansen.County Attorney Demo said this morning that many unfounded stories and misinformation circulated Sunday and early today on such matters as to the location of the shooting and' stabbing, the circumstances, and persons involved or present at the scene.Mr. Demo said he was informed about 11:30 p.m. Saturday by Chief of Police Molden that there had been killing. When he arrived at the scene described by Mr, Demo as a shack at the southwest corner of East Eleventh Avenue and East Street, the body of Ervin was near a rear door, to the right of a step down to a kitchen area; Ervin's head was on a step and his throat had been cut.The county attorney reported (hat ar ambulance had been called ta'i-er, but Ervin’s body had not been moved because hewas dead. Later tne body was taken by the Robinsjn Ambulance Service to the Roberts-Blue-Barnett Funeral Home.The county attorney reported that he called Dr. Lattimore, a Topeka pathologist, to perform an autopsy, but an autopsy report had not been filed up to 11 a.m. today. The county attorney states there was evidence that the man had bled to death, A butcher knife allegedly used in stabbing Ervin, new is in possession of police as well as a ,20-gauge shot gun hold as an exhibit in the wounding of Mr. Carter.Mr, Demo emphasized today that information preceding and involving the altercation shooting, and stabbing has not been fully, confirmed, but investigation and questioning will continue.County Attorney Demo explained the second-degree murder charge against Cart°i\ alleges unlawfully killing of another person with malice aforethought. A first-degree murder charge involved premeditation or design.During the investigation by County and city officers early Sunday morning there were a number of by-statiders and curious spectators from neighboring apartments around the tract but not in the house.Records at the County Attorney’s office, Sheriff’s office and in Lyon County District Court, show that Mr. Carter is an ex-convict, having served a term in the State Penitentiary at Lansing.
