An Instructed verdict of not guilty was returned by the Jury In the case of Ira Degg, on trial on a charge of statutory criminal assault In the Sixteenth District Court, Wednesday morning about 9:30 o'clock when motion of the defense to that effect was sustained by Judge C. R. Pearman. Tho state rested Its case late Tuesday afternoon and on the opening of court Wednesday morning the defense presented Its motion based upon the ground that the state had wholly failed to make out a case against the defendant and that th* evidence was Insufficient as a matter of law to prove the defendant guilty of any oltense.The motion set out that the prosecuting witness testified on cross-examination to an act which is barred by tb ยป-.statute of limitation and thtit that act being barred the state Is precluded from securing a conviction.The Jury was out of the court room when the motion \yas, presented and argued briefly and transcript of the testimony of the prosecutrix wss read before Judge Pearman. When the Jury was brought in Judge Pearman wrote out the verdict It should return and instructed C. E. Miller as foreman to sign* the verdict and excused the Jury.
