H. Milli-ken and W. R. Wolters at gun's point and making off with about$500.The indictment names him as having taken the money and also a pistol which the pair carried off from the bank.Firearms Count Not ReadThe count of the indictment which alleges the use of firearms was not read to the jury by County Attorney Judge Gambill. The possibility of a death penalty was thus automatically eliminated.State’s witnesses went on the stand to tell of the robbery and of the two-hour chase across four counties by which Constable D. H. Street and Representative Bullock Hyder ran the pair to earth with their capture at Howe, in Grayson County.At noon recess, the state had not officially announced its case rested, but it was understood by the court testimony had about closed and defense testimony was due to begin.Brooks himself was expected to take the stand to testify he has never been convicted of a felony offense and. though the law prohibits the giving of a suspended sentence in a robbery case, to seek the lowest penalty the jury might assess.The jury selected to hear the Brooks case was: Clarence Porter, Elbert Stover, Herbert Herring, Joe B. Smith, W. K. Miller, D. S. Carpenter. John Calvert, Newt Allen, J. O. Adkins, W. A. Pockrus, H. V. Shepard and Lonnie Hoskins.Three. Are Sentenced Three pleas of guilty had beenheard by the court, all waiving trialby jury.Cecil Copeland, pleading guilty to possessing liquor for sale, received a two-year suspended sentence. Rail Hopkins pleaded guilty to burglary and received ft three-year suspended sentence. Joseph A. Werle, recently convicted on a burglary charge here, pleaded guilty to forgery and received a two-year term. The perjury charges were filed in connection with the burglary trial, alleging false testimony was given by Werle.
