That she saw a manI get off the wagon walk to thehead of the team, disengage theneckyoke, which he carried hackto tlie wagon and hit a man overthe head a couple times, utteringat the time an oath, lie then proceeded to replace the neckyokeafter which he drove on. It wasn'tlight enough for the witness to recognize the men. hut she coulddistinguish their movements. Thebody of W agner was found abouta quarter of a mile from wherethe assult occurred, lying off atone side of the road. He was unconscious when found and remained in that condition till death.
