TERRE HAUTE TRIBUNE.New DamagesAsked in DeathOf HusbandA West Terre Haute mother offive minor children, widowed by the July 4, 1959, Dresser slaying of the children’s father in an arrest altercation, is seeking Terre Haute Federal Court judgments totaling $124,000 on the basis that one of the defendant members of the shot- firing 000.The plaintiff, Mrs. Winifred Favre, who resided in Dresserat the time of the mishap, filedthe complaint Wednesday afternoon in the U. S. Southern District Court here through her attorney, John A. Kesler.Named defendants in the order in which they appear on thecomplaint are the Travelers Indemnity Company of Hartford,Conn., Everett Eugene Brewster and Robert McAllister, both listed as residents of RR 1, West Terre Haute.Won Earlier JudgmentThe current filing followed a 1959 suit in Vigo Superior Courtin which Mrs. Favre won a $27,500 judgment last April 21 as administratrix of her late husband’s estate. Therein, she alleged Favre’s death was wrongfully caused by Brewster and McAllister, both charged in the complaint with negligent and improper discharge of duties as constable and deputy constable.Facts of the five-year-old case allege that Favre tried to talk Brewster, Sugar Creek Township constable at the time, andThursday, July 2, ’64this deputy, McAllister, from arresting one Charles Howell.
