Joseph WarfDecides toServe Term 'Joseph C. Warf, 33-year-old Helena hair stylist, who was convicted Saturday ol second-degree murder, was on route to the slate prison in Deer Lodge at noon to-Sstlt;day to start serving a 10-year sentence imposed by District Judge Lester H. Loble.Warf had asked his attorney, John W. Mahan, Friday not to request a new trial or appeal the conviction. He denied, however, that he was guilty of “murder in any degree.”Sheriff Dave Middlemas and Deputy Sheriff Larry Lylte took Warf and Estel Dobson of Helena to the state prison by car. Dobson was sentenced to serve five years in the penitentiary. Dobson had pleaded guilty in justice court to committing a lewd and lascivious act.In a statement to his counsel, Warf said he could not raise the $20,000 appeal bond to be released from jail pending a new trial.“Therefore,” he said, “by the time a new trial had taken place,I would have served most of the sentence of one year, nine months and 15 days.But in my heart, I will never be guilty of murder in any degree and when the time is served,I hope to return to Helena and make my home with my wife and baby and continue business there”His mention of “one year, nine months and 15 days” referred to bis best possible parole date.Warf was charged with first* degree murder in the Nov. 17 shotgun slaying of Raymon C. Toll, Helena carpenter. He pleaded innocent and testified at the trial that the shooting was in self-defense.
