Butler jury indicts Wagner in Hamilton woman's deathByNANCY BAKER JournahNews Writer A special session of the Butler County Grand Jury returned an indictment late this morning charging Richard Neil Wagner Sr. with two separate counts of aggravated murder in connection with the Jan. 17 stangulation of Mrs. Violette Schisler.County prosecutor John F.-Holcomb said the two counts were returned with each alleging a separate criminal act.Count one alleges. purposeful killing during the commission of aggravated robbery and count two alleges purposeful killing during the commission of rape.Holcomb said the jury examined six witnesses before returning the indictment which carriesspecifications making possible the imposition of the death penalty.*'Wagner, 42, YMCA, N, Second St., was scheduled to appear fur a preliminary hearing Friday in Hamilton Municipal Court. Thai hearing is bypassed with the return of Ihe indictment today, Holcomb said.Wagner was brought to common pleas court Wednesday for an indigency hearing to determine whether legal counsel should be appointed to represent him.Judge Fred B. Cramer held Wagner is without funds to employ a lawyer and Wagner requested that Hugh D. Holbrock be appointed by the court to represent tiim. Under the new Ohio law, an indigent defendant may choose a lawyer to he appointed for him by the ccurl at. taxpayer's expense.Judge Cramer said there would be two lawyers appointed to represent Wagner because of the nature of the charge and if Holbrock did not accept the appointment, the court would appoint the-lawyers.Wr.gner was charged Tuesday nighi hy Hamilton police with the death of Mrs. Schisler, at her home at C18 Armo Avc.Police chief George V. McNally said Wagner was a former employee or Mrs. Schisler, who had operated the Earlmar Rug Cleaners until her retirement in 1974.Mrs. Schisler’s body was found Jan. 20 tied on a ted in a second-floor room or the home where she lived * alone. Dr. Garret J. Boone, counly coroner, said she had been strangled and sexually assaulted.Wagner appeared in a hearing before Municipal Judge Richard Berridge Wednesday and bond was set at $50,000.
