Former airman gets reprieve on deportationPITTSBURGH (UPI) - A former U. S. airman from Ell-wood City, Pa., who had been ordered deported to Japan to 1 face a prison term there, was granted a reprieve as he was• about to board a plane for• Japan.1 Terrance C. Stone, 23, was at ; the Lockport, Ohio, Air Force Base when federal judge Louis Rosenberg in Pittsburgh ordered . Stone confined within the jurisdiction of the court for 72 hours while he ruled on an appeal of his decision ordering.Stone deported.Earlier Friday Rosenberg de- 1 nied Stone’s petition that the Air Force be prevented from returning him to Japan where he faces a term of six years at hard labor for robbery and attempted rape.Stone was then taken by Air Force police to the Lockport base. His attorney, Harold Gold, filed notice of appeal and officials began a search for Stone to prevent his departure.Stone was convicted by a Japanese court of the armed robbery of about $50 and attempted rape while he was on leave there. The decision was upheld by the highest Japanese appellate court Stone had escaped from an American military prison and flown home Sept. 12. He appealed his arrest and was housed in the Allegheny County Jail until Friday.Rosenberg rejected Stone’s contention that the Air Force no longer had a legal right to custody of Stone because his enlistment expired. The Air Force cllaimed Stone’s four-year enlistment expired in September of 1968 but said Stone had extended his enlistment to receive legal aid and government protection while he was being tried in Japan.Rosenberg cited an international treaty with Japan which places criminal offenses under Japanese jurisdiction.
