Student arrestedCook shot in hand in row with patron over food billPOMONA — A cook was shot in the hand shortly alter midnight today in a dispute over whether a customer had paid for food at the In-N-Out Burger, 2540 N. Towne Ave.The wounded man, Kenneth Allen Lugenbee!, 19. Claremont, was reported in satisfactory condition today at Pomona Valley Community Hospital. He underwent surgery shortly after 3 a.m. lor removal of the bullet from his left hand.A few minutes after the shooting, police arrested Anthony Wayne Warren, also 19. of 2195 Ramsey Way. and held him in connection with the shooting. Warren, a student, was booked on suspicion oi assault with intent to commit murder, robbery and assault with a deadiy weapon.The suspect was arrested nearby at Arrow Highway east of Towne Avenue after the police helicopter crew spotted him from the air. He was carrying a hamburger and sack from the In-N-Out at the time, police said. They also reported finding a 38-caliber revolver abandoned nearby.Police gave this account:Warren oidered food at the walk-up window of the place and then walked away until it was about ready. When he returned. Lugenbeel asked to be paid but Warren claimed he had already paid. The amount in dispute was $1.31.Warren turned, walked away, pulled the Run and returned to the window, demanding the food. Lugenbeel raised his left hand, saying, Okay, I'll get the hamburger,” and was shot.He fell to his knees and Warren ordered him to get up and get the food. The victim did and Warren ran.Officers said Lugenbeel’s hand was about four inches from his face when it was hit by the bullet. One other cook. Warren M. Pasquarella. 28, Pomona, was at the scene, as was a friend, Robert S. Hanes. 19.Investigators said that Warren refused to make a statement after his arrest.
