Its Continuance Before Justice Calef tills Horning.The bastardy case that has been occupying the attention of Justice A. B. Calef in ', his office for the past two days, was re-', sumed this morning, when witnesses for , the defense Were examined. Before wit-, nesses were called Minnie Carey was re-' called and stated she wished to correct her testimony of yesterday, in relation to the time when she got into trouble by Merwin; it was either in May or June,and she stated she was most positive it was in May.Mrs. Kate A. Merwin, wife of Deputy Sheriff who is charged with being the father of Minnie's unborn ch^ld, was the first witness examined for the defense. Her testimony went to show that she knew what time Merwin was absent from home and had a complete record of his doings from the first ofJJanuary 1888., Minnie Carey was in her home as much as she was in the other half of the house, for she resided in the same house with ’ the elder Merwlns. She knew when Minnie was unwell last and stated postively that it was in April and said that in June Minnie had tola her she was not that way,and after that time she did not know. She | remarked to the girl in September when she was visiting, about private affairs and | the girl intimated that she was all right, j She recollected the fact of Frank Newton I being at their house after he had left their ; employment and of the girl receiving | presents from him in the shape of cologne | and gloves.. On one occasion while the j family went after trailing arbutus, she | noticed Newton to be familiar with the : girl and in lifting her from the carriage he placed his hand on her bosom. On another occasion she saw Newton kiss Minnie in the dining room and have his arms around her neck.Miss Anna L. Bailey, sister of Mrs. A. Merwin was called next, *and stated she was in Durham at her sister’s in the early part of 1888. Her testimony, if anything, contradicted that of her sister’s in many respects, in relation to the time she went to visit her, sister and when she left.Mr. Andrew Hull, of Durham, a carpenter, was called after dinner and questioned as to the measurement from the house to the outhouse, where the young lady alleges that Merwin was intimate with her.
