Atlanta police apprehendmissing Brewer witnessATLANTA — Johnny Carroll, the missingkey defense witness in the trial of formerTalladega County Sheriff Luke Brewer, isback in custody today after his Jan. 9 escapefrom authorities. FTalladega County Sheriff Gene Mitchell was notified by Atlanta authorities Mondav that they had apprehended Carroll and are holding him for auto theft. Mitchell also saidCarroll was wanted in connection with anarmed robbery in Macon. Ga., according to Atlanta authorities.Carroll was transferred to Talladega from a state prison Jan. 9 to appear as a key witness for the defense in the embezzlement trial of Brewer. He escaped that night from county jail.Brewer was indicted by a Talladega County grand jury last year on charges of embezzlement, buying, receiving and concealing stolen property and challenging to a duel andthreatening and harrassment over the telephone.The Alabama Supreme Court impeached Brewer last September. That action had been recommended by the grand jury.The embezzlement trial had been set for Jan. 15 but defense attorney Huel Love motioned for a continuance after Carroll’s escape.Special judge L. S. Moore of Bibb County, who was appointed by the state supreme court to hear the case, granted the continuance and set the new trial date for March 5.Meanwhile Carroll's wife, Joyce, has been held in protective custody since his escape.Both the Carrolls' testimony was expected to deal heavily with an allegedly stolen car which Brewer confiscated from Carroll and reportedly turned over to Clarence Cook. Cook was indicted by the same grand jury that indicted Brewer.
