Mo wa» Tried at AVbloii Last Week and Given T lirce Yean 11 Michigan City. ,The Inst chapter in the celebrated Carter case was enacted in the Noble circuit court Inst wcok, when tko accused was tried and sentenced to a term in the state penitentiary at Michigan City. The easo was called on Thursday afternoon and very naturally drew a crowded house. The enSo was made prominent by tbo circumstances nnd ahlo attorneys were secured on either side, the state being represented by Prosecutor Peterson assisted by Attorney Emanuels of Auburn, while for the defense Henry G. Zimmerman and K. P. Barr appeared. Miss Lizzie Long was the first witness sworn, who occupied the stand over one-half day, when several witnesses were iDtTodueed to prove Miss Long’s previous good character. The letters which have been published were also introduced, and cut quite n figure in tho trial. At the conclusion of the examination of witnesses for llie state, the defense rested the case and introduced no witnesses whatever, The arguments of the attorneys began on Friday afternoon and lasted until about ? o'clock, when the case was given to the jury, who were out until three o’clock Saturday morning, returning a sealed verdict, which was read at the opening of court at!) o'clock, fixing Carter’s penalty at three years in prison. Tbq jury was composed of good men, who carefully weighed the evidence. and all agreed on entering the jury room at the close of the case that the defendant was guilty. There were mitigating circumstances developed during the trial which no doubt served to lighten the sentence, and which were no doubt considered by the jmy, hence the sentence of three years instead of five, as the prosecution worked and hoped for. It was shown that the young lady, Miss Long, was decidedly too fast, to say the least, and while that was no excuse for Curler’s act in doing what he did, yet it had a bearing no doubt. Carter received his sentence in calmness, exhibiting no emotion whatever, though he no doubt realized what was before him and the deprivations he must endure.in company with Sheriff McLean the prisoner passed through Ligonicr on Monday on his way to Michigan City to begin his sentence. To the editor of Tut-: Leader he said lie intended to behave himself and get all the time he could, expecting to see Ligonicr once more before many years, lie seemed resigned to his fate and it is to be hoped that the experience which bus been so costly to him will serve to do him some good when he is released. By good behavior lie may be able to get out in two and one-half years..Mrs. Carter, wc understand, will not gel a divorce, having, abandoned the idea ainco the result ot the trial.
