Low er Sat-s.Death ChargeIs DismissedA manslaughter charge, filed almost two and a half years ago, against Jerry Van Lane was dismissed here Thursday by District Judge Kenneth Shilling who sustained a defense demurrer based on a legal technicality on the face of the information.Lane was charged with the Sept. 11, 1969 traffic death of Mike Adams, 15. He was bound over earlier this month to face trial on the charge.Assistant District Attorney Tom Car lock said Shilling sustained the demurrer because Lane’s manslaughter charge was based on the recommendation of a trooper who said Lane’s car had faulty brakes. Carlock said the law states that any person who causes a death vi bile committing a misdemeanor can be charged with manslaughter. Faulty breakes is not specifically mentioned as a misdemeanor, Carlock said.‘We are taking this matter under advisement,” Carlocksaid, “to determine whether to re file the charge.”4
