Finley paid a fine J g] for the assault but later Belk sued Finley for $1,000 damages, claiming, w that the blow had Inflicted permanent j Injuries to his nose. Belk claimed j g that his nose was broken by the blow ( ^ and that it had become badly swollen 1 ajand Inflamed and was causing him ?jL] much pain. On petition of the defense * the court appointed a commission of three physicians who made an exami-' nation of Belk’s nose and testified on that stand that the diseased condition of his nose was due to catarrhal troubles and this lost Belk his suit.P
