Finley,1 ]returned a verdict about 1 o’clock i Sunday morning finding in favor of (1 the defendant. It is reported that the tJury stood 10 to 2 for the defendant Ion the first ballot and that these two j 1cmen succeeded in deadlocking the ! 1 jury for twelve hours when they fin- j c ally came over and voted against r/vrr ^elk damages.Belk ; suing *Finlev for $1,000 r darrp ?'■ f~r injuries which he alleges 1' he bowtaiutd by reason of a blow on j the nose which he received at the hands of Finley. Finley paid a fine J g] for the assault but later Belk sued Finley for $1,000 damages, claiming, w that the blow had Inflicted permanent j Injuries to his nose. Belk claimed j g that his nose was broken by the blow ( ^ and that it had become badly swollen 1 ajand Inflamed and was causing him ?jL] much pain. On petition of the defense * the court appointed a commission of three physicians who made an exami-' nation of Belk’s nose and testified on that stand that the diseased condition of his nose was due to catarrhal troubles and this lost Belk his suit.P
