Is ac-cused of striking In the head, and news of which was published EXCL.U-SIVELY In the Californian on Saturday last, lies cold in death in the county hospital, and the grief stricken brother must face an accusation of fratricide. The wounded man was operated on by Drs. Schafer and McIntosh this * morning at 10 o’clock at the urgent request of the brother, though the physicians said In advance that there was no hope, the skull fracture being fatal. The wounded man died an hour after the operation. The preliminary examination which was to have been held at Mojave yesterday was postponed until Thursday, and it will now be doubtless further postponed.m*itsto,'S'ver-l'Brail trnheinre*,rdforIz-itsonbyenbeby,heanewjrnds.er-i Dr. Schafer was called to Mojave to examine the wounded man last night.H© found him in a comatose condition and hopelessly injured. There was one chance in a thousand that relief might come through trepanning, though he-thought this doubtful. He absolutely refused to perform the operation there and at the insistence of the anxious brother, the Injured man was brought to Bakersfield. His condition at the hospital gave little hope that the operation would be successful, but as death w$s but a matter of a few hourB, at the earnest solicitation of the brother, the operation was made, and the brain relieved of the pressure from the broken skull. The injured man did not rally, and death resulted at 11 o’clock. The skull showed that a terrific blow had been delivered by some blunt instrument, probably a hammer. The dent in the skull was of the size of a 25-cent piece, and the bone was mashed down upon the brain, where a blood clot was formed.Coroner Mullins was at once notified by the doctors of the death and under what conditions, and an inqueBt will be held.John McConaha who is said to have struck the fatal blow, accompanied his brother to this city, and anxiously awaited the result of the operation at the hospital. He is heart-broken over the outcome of the difficulty, as he says nothing was further from his intention, than to injure his brother.‘Tuesday’ at the time set for the examination a continuance of two dayswas ordered by Justice Reddy in the face of the earnest protest of the accused who was in court prepared to defend himself.According to statements made by John McConaha, he does not deny or affirm having struck his brother. The Injury was inflicted in a row as, before stated, between Thomas and N. W. Lindroth.a hired man who worked in John McConaha’s stable and lived at the home of the other brother. The latter had been sent to Tehachapl on some business and returned to Mojave just at meal time. It was said he was jealous of Lindroth, and entering the house, he at once proceeded to eject the hired man. John interfered and In endeavoring to separate the two, the brother received his hurt. The accused man says he cannot remember whether he struck his brother or not. He was endeavoring to part thecombatants, and he cannot recall how much force he used.If he did strike him, he says, he was justified in order to prevent his brother from doing Lindroth great bodily harm. The latter at first said that a blowhad been struck but it is understood he will now testify that the injury was received in a fall. The examination will be held in Mojave on Thursday, and Mr. Coil will represent the District Attorney’s office. The accused man has always borne am excellent reputation. He has lived in the county for many years and is a member of the Baptist Church. His friends here are certain that it will be ascertained that no intentional] crime can be laid at his door. In a letter to the Californian. Mr. McConaha vehemently disclaims any wrong doing, and says that an investigation will set him right.
