Mark Hendry Enters PleaBy JOE KOLLIN Staff WriterMark Alan Hendry, 18, has pleaded innocent to a charge of violating the conditions of the probation that allowed him to remain free.Hendry, the son of Collier County's former sheriff, was given probation for three years on Nov. 3 after pleading guilty to a burglary charge.A month later, on Dec. 10, he was arrested on a new charge accusing him of grand larceny.THE FLORIDA Parole Probation Commission then filed the charge accusing him of violating two of the conditions of his probation.Monday, Hendry pleaded innocent to the probation violation charge. Circuit Judge Charles T. Carlton, who gave him the probation, set a hearing for Feb. 2. At the hearing the judge is to decide if the probation terms were violated. He can send Hendry to prison for up to five years or restore his probation.The arraignment Monday was only on the probation violation charge. His arraignment on the grand larceny charge, the time when he will plead innocent or guilty and have a trial date set. is scheduled for Jan. 19.The teenager faces a total of 10 years in prison, five if hisprobation is revoked on the burglary charge and another five if he is convicted on thegrand larceny charge.The public defender has been appointed to defend Hendry on the grand larceny charge. He told the judge Monday a private attorney will represent him on the probation chargeTHE BURGLARY charge accuses him of breaking into a Tamiami Trail restaurant. The grand larceny charge contends he stole a car engine.The charge of violating his probation contends he broke two rules he was to live by: he was to remain at liberty without getting into further trouble, but he got into further trouble by being arrested, the charge states.
