Captain Foley hasvisited him and says that he is suf-*ferine a great deal and may lose the sight of an eye as the result of the sudden contact with the big fist of the husky horsetrader. His family fears that he may become blind, but it is not likely that he will lose both eyes. Fair is still in jail serving time for the assault. He will probably be held until the extent of the elder Bingaman’s injuries isdetermined.Late this afternoon John Bingaman, son of Abe, filed an affidavit in Justice Guthrie’s court, charging Fair with malicious mayhem.
