ALIBI FOII Mil;.Man Serving Lift* Trim May SecureIlls Freedom.Oklahoma City, Jan. 4.—Evidence which, it is believed, will successfully prove an alibi is being collected to be presented in a petition for thepardon of James Nite, now in a Texas penitentiary, where he is serving a life sentence for the robbery of abank in that state in 1894 and of which the present governor, Thomas M. Campbell, was president.Charles Robkion, once chief of police of Tujsa and who was ahorseshoer near the village of Tulsa years ago when the Dalton brothers rendezvoused t here, says he shodthe horses of the bandits about thetime of the Texas bank robbery andthat the crime was committed bythe Dalton gang and that Nite hadnothing to do with it. •Some months after the robbery of the bank, Robinson says, he met two of the gang on the Cimarron river.They told him that one of the gang was killed at the time of the robbery. Bill Dalton was killed some months after that. Robinson's statement has been secured and sent to Governor Campbell and will be used in the effort to secure the pardon of Nite. ^ I;: ©R
