IN BENETTI CASE IS DENIEDClaiming that Interna.] revenue-I agents violated two amendments of, the United States constitution in'isecuring- information from Angelo, Benetti. who Is rhargpd by the government with income tax evasion, Samuel Piatt, Benetti's attorney, moved that the court instruct the jury to bring in a verdict of acquittal. at the trial of the Reno slot machine and liquor dealer in Carson yesterday.The court denied thr motion butstated It would give It further consideration. !Platt stated that intern?.] revenue agents, prior to the time Benetti was Indicted, put him or. oath and intrr-rogated him concerning his income tax returns, and that in so doing the fifth amendment of the constitution was violated in that they required Benetti to testify against himself. The defense also urged, in suppc-rt-of the motion, that through unlawful search and seizure, in violation of the fourth amendment, the government obtained information that Benetti was manufacturing and selling liquor. Platt- added that the indictments against Benetti for this charge were dismissed by the court.The defense also contended that for Benetti to file a sworn income tax return based upon an illegal business that he would as a m be compelled, in violation of the fifth amendment, to incriminate himself..
