XOT ANSWER IOWA IXDICTMEXT —STATE CAXXOT BEACHSEARS-ROEBUCK.• *DES MOINES, Feb. 24—By simply ignoring- the indictment returnedagainst it by the federal-grand juryin Des Moines two years ago the Sears-Roebuc'k company of Chicago will escape trial on a charge of using the mails to defraud. In an opinion handed down by Judge-McPherson of the United States court yesterday, it is .held that the, big mail-order house cannot be compelled to appear, for trial in the federal court here.Judge McPherson points out that a corporation cannot be arrested and brought before the court as would be done in the case, of One individual, and there is no federal statute .which requires a corporation to go into another. state to stand trial if it does not wish to do so.
