A. O, Eastman, n Civil war veteran, is the plautiff, and Jonas Carlson, a neighbor, is the defendant. The petition, which was filed this week, asks damages in the sum mentioned for false, malicious and slanderous statements made against anil about the plautiff during the years 1021 and 1022. The petition recites that “In about the year 1021, the above named defendant entered upon a course of conduct for the purpose and with the intent of injuring and damaging this plautiff by destroying his good name and repute, and by degrading him in the opiniou of his associates and all persons with whom he might .some in contact, or who might know him.” Other paragraphs allege that the do feiulant has called the plaintiff a “murderer,” that lie is a “crook” and time he has been guilty of larceny; that ho has charged in the presence of various persons that Eastman stole lumber that Carlson had secured to build a house, etc.The feud between Eastman and Carlson is not of recent date. Some two years ago they engaged in a wordy battle which was only terminated when Eastman secured a pitchfork and batted Carlson over the head. Eastman- Iwas arrested and brought In Kook Rap-ids for trial, but was discharged.Other cases which have been filed iu the district court this week are Plant Rubber Co. vs. A. P. Sehrooder, a suit: to collect a note for $40; It Wibbcus Bros. vs. Claus Wiorsmu, tocollect $1,215.50 for (wo years vent on a farm; Henry Rsuter vs. R. (\ ami Elia Hauer, on a $2,000 note; National Life Insurance Co., vs. 11. W Brockmeier, Elizabeth Ilrockmoier, executrix* of (he. estate of IL W. Broekmoier, and Jacob J1 nuts, a suit to forclosc a mortgage for $22,000 ontin* north half of section 2-00*44; the Alvord Rank vs. K. O. .tolluni on a nole for $2,700; First National bank of Little Rock vs. Pol or Meincrls, for $484.80, the balance due on a note.The Palmer Fruit Co., of Sioux City has brought suit against flic Farmers’ Mercantile Co., of In wood, for$100.40, and Wyman Partridge Co. is suing the In wood Rochdale Co., which is alleged to be the same institution, for $3,000 on account; II. J. Merlein, executor of tin* estate of Klass WaHermann, asks $1,041 as rent of thewest half of section 10-100-4J from J.%II. Vanllove, and Margaret Kellihan asks judgment, against Win. Monlux for $1,200 on notes given for tho purchase price of a house located on the north 50 foot of hit 1, block 17, original plat of Rock Rapids, and the forclosure of a mortgage on the premises.The term of court will begin March 5. with Judge Bradley presiding.
