Wing, (he defenant, aud Mrs. Wing, his wife Their account differed somewhat with the principal witnesses of the state regarding the alleged injury to defendant's wife—the defense insisting that the handling was rough and unusual, while the policemen claimed this was untrue.Thursday afternoon the %tor torneys for the defense attacked the validity of the writ issued by Judge Stacy, relative to the removal of Fred Wing from his home to the pest bouse, arguing that the officers were civil trespassers and had no legal right to remove a sick patient from ms home to a public detention hospital.On Friday the court delivered an opinion sustaining the defense in their position of the illegality of removing a person having an inreoUous disease from his home to a hospital, wfeta the home is in a bouse hgviug but one Cam ily. The court held that this right of removal only applied topersons having no home anq stopping at public places.
