UinsteadRefuses Clemency In Case Of Doomed NeqroRALEIGH (/fl—Barring ah appeal to the Federal* Courts,, a .convicted Negro murderer will be executed In Central Prison’s ^gas chamber.Gov. Umstead announced yesterr day he had carefully considered the case of Lafayette Miller. 21. and would not intervene. It was his first decision on a death case.Miller^ was'convicted in Beau- ' fort County Superior Court in January, 1952, of murdering Harvey C. Boyd;; Chocowinity farmer, the night of Thanksgiving Eve, 1951. His case was first studied by then Gov. W. Kerr Scott who declined to extend clemency. Attorneys then filed an appeal to “the State Supreme Court; which upheld the lower court decision. •The governor also conferred yesterday with Paroles Commissioner N. F. Ransdell about four other Negroes on death row. Execution dates will be set when a U. S. Supreme Court, decision is officially certified by the State Supreme Court. The 'U. S. high court upheld the death sentences against the four men. ,They are Raleigh Speller, thrice convicted in Bertie of raising a white woman; in 1947; Leroy and Liovd Ray Daniels, cousins, con-|victed in Pitt County in 1949 of the robbery-murder of a Greenville taxi driver; and Clyde Brown, convicted in: Forsyth erf raping a 17-yearrOld white girl*
