The prisoner pleaded “Not Guilty,” and was placed in charge of the Jailor while the Court held a reoess.for dinner. ■'*' *AFTERNOON SESSION.Mr. Arthur applied to the Court to excludefrom the hall the various witnesses, excepting the single one called upon the stand. The order was made. Judge Stallo asked that Mr. Tafel might remainto take notes for him. Mr. Arthur objected, and Mr. Tafel was excluded with the other witnesses, all of whom were charged by Judge Moore not to talk with each other about the testimony they were prepared to give.Clinton Butts was first called to the stand, and stated : I live in Covington: on the 12th of M iy last, in the evening, John Wamock came to me and said the Turners had been making a fuss on the hills, and I was wanted; I went to Scott street, which is in Covington, between Fourth and Fifth; I there met the Turners’ procession. There was much excitement among the crowd: I arrested a man who was pointed out to me; I told him I was the City Marshal; this was on Scott, near Fifth street; I took the man from the procession: I was applied to to take another of the Turners; I called upon two persons whom I knew to assist me, and arrested the man: he asked who I was; I told him. Armstrong, who was with me. said: “Gentlemen. this is the City Marshal.” Some of them said, “D—n tKe City Marshal; kill him.” I was then attacked; one man struck at me with a rapier; I was violently struck on the back; I pulled out my pistol,and, wheeling round, suapped it at two or three of them: I then saw one of them leveling a gun at me; I stooped down: the man fired, and I was struck in the arm.
