\ Hard-Fought Case. . |• • .By far the hardest-fought case yet \ on trial began-shortly before noon 1 yesterday and is still on trial. Leslie [ and Foy Cummings and Brown Lowrey. Indians, of Pembroke, are on trial for the killing of D. \\r. Stone of Pembroke,..who met his death when run.down by a passing automobile in the: town of Pembroke on the night of Dec. .8. '!;The State has not made out a strong case ;yatt -and the defense is making an, attempt to tear into shreds the testimony, ofJone Charlie Lowrey, one of the State’s principal witnesses, who has made escapes from the county chain gang, the State insane asylum and.the county home, and is now serving a term in jail. Lowrey claims he was in hiding in an alley beside Odell Carter's store in Pembroke about the time Stone was killed when he saw' u car come up, the Cummings I boys. Brown Lowrey and “some other tall man’,’get out of a car and.come into the store. As he was making a get-away, he saw some one come out the rear, of the store. A Ford touring car, bent considerably on the left and thought, to be the one that struck Stone, was found in front of the Carter store--and identified as that of the Cummings , boys. A stream of water .followed from where the car struck Stone, as far as the hard-surfaec continued, within a few feet of where this c*r was standing. The defenseclaims the car was itolen.i.;A nuipber of character witnesses, among them some of the most prominent while and Indian people of the Pembroke section, gave the Cummings Sioys and I3fowh Lowrey splendid reputations. and Charlie Lowrey a bad one.A- .large crowd is attending the trial, apd keen interest is manifested in all the'testimonv.
