Feb. 3, 19 76 3AProbation Action PostponedIt was a double-barrel move that 18-year-old Mark Alan Hendry took Monday in court.And the move resulted in at least a two-week delay in any action that could result in Hendry’s being sent to prison for five years.Hendry, of Coconut Drive, was in Collier County Circuit Court Monday for a hearing on charges that he violated the terms of the probation that allowed him to remain free rather than being sent to prison on a burglary charge. InNovember, facing five years in prison, the son of the county's former sheriff was given three years probation.HE WAS required to abide by the terms of the probation to stay free. If he didn’t, he faced revocation and prison.In December, one month after he was given probation, the Florida Parole and Probation Commission asked a judge to revoke the probation on twogrounds: that Hendry violated his promise to attend “group experience” meetings conducted by the Collier County Mental Health Clinic, and that he violated a second condition, requiring him to remain at liberty without violating any law, when he was arrested on a grand larceny charge while on probation.The commission said thatbecause he violated the two terms. Circuit Judge Charles T. Carlton should revoke the probation and send him toprison.At his hearing Monday, Hendry pleaded guilty to missing the meetings, Carlton said. But he pleaded innocent to violating the law while free on probation.Carlton said Hendry'sprobation supervisor suggested postponing action on the probation issue until the new case against him is concluded. Carlton agreed, although Hendry's admission that he violated the one term of his probation was sufficient for the judge to revoke it and send him to prison.THE PROBATION was given Hendry after he pleaded guiltyto a charge of breaking into a restaurant on the Tamiami Trail North in Naples.In December he was arrested on a charge of stealing an auto engine.
