Pritchard was found guilty of having assaulted Pritchard in a manner which the state alleged caused his-death, according to the verdict of eight women and four men, returned in common pleas late/Friday.Following the charge of Judge W. D. Fiesinger the case, was given to the jury at 1:55 o’clock Friday af* ternon. Arguments ‘featured the morning session.Prosecutor C. E. Moyer argued first for the state, reciting the allegations that Hastings had-struck H. J. Pritchard a blow, On Nov. 24, which rosuUed in Pritchard’s death on Nov, 7. He told the incidents of, the ■tilering which preceded the alleged .-uult, and severely scored Hast-gis, Justin Neill who was indicted , .th Hastings, and A1 Htiber, state /ilnes recalled by the defense.He branded Hastings’ story of having been assaulted by Wm. O. Rogers ae unreasonable and argued that it had not been mentioned up to the time., of the trial.Defense Attorney Janies F. F\ynn, indicated that Rogers the state's star witness had conspired against Hastings. He argued that it was stfange that Rogers alone had seen the alleged assault by Hastings and took exception to. the form of the indictment.Defense Attorney Beig criticized Rogers as having been too interested and said he had plenty of time to “fix” evidence to dodge punishment himself. ,He pleaded that if Hastings struck, he struck in self defense, and that Pritchard died through lack of appli-tion of medical science and failure of x-rays to show the fracture.Beis roundly scored the witnesses for their accounts of why they went to the N. Depot*st home; and sdid’ none of them were men enough to teU the reason. Pritchard was scored for having ventured into the place, since he was a married man.Attorney Henry Hart concluded for the state, summing up the prosecution and assailing the arguments and testimony of the defense.
