nies.William Borders, bartender at Lou Smith’s saloon, said that all the three men came into the saloon on Jan. 3. Bones bought a pint of -whisky for which he paid with pennies, counting out fifty pennies in payment. He said to Borders at the time he had $1.50 more in pennies that he would like to get rid of. Borders notified Patrolman Wykoff and officers went in search of the men and found them a mile fronjg«| town, where they were seated around fire, pretty drunk. They were arrested and searched and a lot ofpennies found on them.Patrolman William Wykoff said that he found 49 pennies in Bones’ pockets, nine in Gray’s and none in Jones’. They also had two bars of Lenox soap.Mrs. Charles Yalin testified that two men whom she was pretty sure were Bones and Jones, came into her husband’s saloon Jan. 2. Bones bought fifteen cents’ worth of liquor for which he paid in pennies. He said at the time that he had bought $2 worth of pennies that morning down town.John Walters, a saloon keeper, said Gray was in the saloon Jan. 3, at 6:30 a. m. and bought whisky for which he paid ten pennies.Henry Volpert, saloonkeeper, said two men who he was very certain were Gray and Bones were in his saloon on Jan. 2 or 3 early in the morning and later in the forenoon and spent forty cents for drinks for which they paid with nickels.Chief of Police Thomas J. Call testified that ay had told him that ha bought the two bars of soap at Peter Summer’s grocery in Washington a day or two before the arrest. Bones told him that he got the pennies in his p03 • session by peddling needles and shoestrings.Fred Massie, clerk at the grocery store referred to, said that Gray and Bones both came into the store at different times on the same day and bought 20 or 30 cents worth of goods but he could not remember what it was that either of them bought. They both paid for the articles in pennies.Judge Wartmann bound the prisoners over to the Federal grand jury and fixed the bonds of Gray and Bones at $200. They were taken to Ind ian 0* lis by United States Marshal Johann.
