HEARING POSTPONED A DAYThe Case Against Max Westphalen was Postponed by Mayor Straight TUI Tomorrow—He Has Grievance as Weil as Richardson.Arthur Richardson, a young newsboy who peddles the Register and Leader, the Omaha Bee and some other papers on the street, got into a little trouble in Max Westphalen’s billiard hall and preferred charges against the proprietor. It seems that Richardson is a minor and therefore not allowed’ in a billiard hall and that he went into Westphalen's place of business and was told to get out. Anyhow, it resulted in Westphalen chasing young Richardson and the latter upset some billiard balls and it is also claimed by the defendant that he struck his head against some kind of wiring in the hall and produced some scratches on his forehead. Richardson claims that Mr. Westphalen slung a billiard cue at him and that it struck him on the head and that that was what caused the injury to his forehead. The case first came up for hearing before Justice Pressnall but was transferred to the court of Mayor Straight on motion made by Mr. Swan, the attorney representing Mr. Westphalen- The facts will be brought out at tomorrow’s hearing.nic-JTOT1CE.
