SANTA CLAUS GIVEN LEGAL STATUS—--- — . . 4_ PITTSBURGH, Dec. 22.—(U.R)— Yes, children, there is a Santa Claus and today Judge Michael Angelo Musmanno gave the mer-rv saint a legal status in his court.“Santa Claus is a reality recognizable by the law and be will be protected in this court against all aspersions and insinuations to the contrary,” the judge ruled in a weighty opinion filed in the court of quarter sessions of Allegheny eounty.A legal status was given Saint Nick because the judge said there has been intimations that warrants of arrest should be issued against department store Santa Clauses on th» grounds they are deceiving the public because they that does not exist.So that no one may be misled,purpart to represent a personagewe heartily dedaie that anyoneinitiating such a prosecution onthe supposition that there is no Santa Claus, will not have only the case dismissed against him, but will be required to pay the costs in addition,*’ Judge Musmanno ruled.The judge who has been in the public prints as a result of his sending drunken drivers to jail, further threatened:“Any one within our jurisdiction who questions the authenticity of Santa Claus will be declared in contempt of court and he will be committed to the bstde, there to be kept in dungeon vileuntil lus soul expands and the spirit of Chi istmas enters therein, when lie shall then be leleased,“1provided he shall- shout withwhole lungs and full heart: “Met-ry Christmas: Merry Christmas!” If the law recognizes John Doe, it will certainly icspect Santa Claus. This court can state with judicial correctness that it has seen Santa Claus but it has never had an; occuiar observations of John Doe “There ate many famous and celebrated characters who nvc as real to us as the fifdi and blood people of our daily contacts, and vet they have not come within the range *»f our physical vision, Judge Musmanno said.“Who has seen Jack Frost, I Cupid—“who visits royal palaces as well as peasants' homes’’— Uncle Sam, the Judge asked But who dares to say that these characters are not leahties?Santa Claus is an actuality for adults akio because parents get their joy from Snta Claus in buying presents, placing them m stockings, and hearing the shouts of the childre,*} when they discover the gifts.“Santa Claus is the symbol of amiable kimmess” the judge concluded “We find further that without him, life would be dull and cheerless, and that with him the heali is merry and the spiritgay, as life should be,”
