Armstrong and E. Dawgon Smith were named special prosecutors Monday afternoon by Judge R. L. Gowdy to handle the4 State’s case against C. W. Latimer, indicted for murder, trial of which will begin in Common Pleas Court Friday.Appointment of the special prosecutors was made by Judge Gowdy shortly after he had accepted the resignation of Prosecuting Attorney J. Kenneth Williamson, who mailed his resignation last Friday to the Judge while the latter was in Cleveland.Judge Gowdy returned to Xenia Saturday night, n accepting the resignation of the prosecutor he said he did so not for the reasons stated in the letter of resignation by Mr. Williamson,but because of the fact that the prosecutor apparently wanted to resign which would handicap the State’s case if he should be compelled to serve against his wishes.The court also held that, the reasons given by the prosecutor for resigning were futile, in that the character of the special venire drawn from which to select a jury insures a jurythat will give its bust attention to the state in spite of the fact that the case is being tried during the holi-ays, that there is no such thing as a judicial year and that the continuance of the trial over the period of the court teim, could not affect the; trial or jeopardize the case of the! state. Answering further causes in the letter of resignation the court said left, the application for a continuance of the trial without ground^.Beginning of the trial on Friday is believed to mean that a verdict will not be reached until some time next week, as the case is expected to take at least three days and possibly four.
