Kennedy BrothersHearings on Writs Scheduled Toda1mRn*lt;\v:Pbi\v•(taaIII)rs Moines lt;/P) -A hearing was scheduled to open in federal court this afternoon on the petitions of Leo and Herman Kennedy, brothers who seek release by writ of habeas corpus from the state penitentiary on the ground that they were imprisoned in violation of constitutional rights.The men were sentenced in Clinton county district court late in the summer of 1941 on pleas of guilty. Leo Kennedy was sentenced to not more than five years on charges of possessing counterfeit papers, a $10 forged check. Herman Kennedy's sentence was for not more than ten years, on a charge of uttering a forged instrument, a $10 check.Leo Kennedy charged in his habeas corpus petition that “a rubber hose was used on him by some Clinton county officers to obtain a confession; that he pleaded guilty to “a crime that he was innocent of committing’1 after the officers threatened that, if he did not do so, they would work petitioner’s brother over with the same hose.Herman Kennedy said in his petition that a plea of guilty en- ] tered for him by a court-appointed attorney was made without his consent and that the information filed against him was vague.nfecJTIT
