One of the important Commonwealth witnesses called during the morning was MissGladys Royer, a waitress employed inOburn's restaurant at Leechburg, She testified to Charles Mack and PeterMonte belle, the defendant, coming into the restaurant on the evening of the shooting of Joeph Coyle, deputy sheriff, and ordering food. Deputy Stivason happened in at the time. What occurred in the dining room of the restaurant Miss Boyer said she could not t«; II us she was in the kitchen, looking after the two men’s ordersbut as she was coming out of thekitch* n she said she w as stopped atthe door leading to the kitchen by Peter Monti belle, who inquired of her, “what right has that big-headed man (referring to Stivason) to order me out.” As he spoke, Miss Boyer testified Montebello grapped for her with one hand, at the same time holding the other hand at the side in such a manner she said she could not see what, if anything, he was holding with it. Miss Boyer said she told Montebello ‘don’t you dare touch me” and another of the girls employed in the place made some exclamation about Montebelle not “shooting.” Mr. Oburn, the proprietor, came out of the kitchen then, according to Miss Boyer, and put Montebelle and Mack, who had remained seati d at the table and had taken no part in the incident, out In the meantime Deputy Stivason had left and when he returned, Deputy Joseph Coyle was along. Miss Boyer tesUlied she told Coyle what had occurred but* said nothing to Stivason about it. Coyle and Stivason started away and 10 or 15 minutes later Miss ; foyer said she heard that Coyle had been shotUn cross examination, Miss Boyer .fraui Deputy Stivason paid the bill for * he food Mack and Montebelle hud ordered but which they had not eaten ut why he did so Miss Boyer stated she did not know. She said rhe had never seen M;v k or Montebelle before that evening and did not knowat the time who they were. She said that Charley Mack did not leave his si at at the tabic after he had enteredami that he had taken no part in theconversation between Montebelle and herself.
