The dismissal of the accused was brought about by testimony to the end that when the alleged victim, Bessie North, with a girl com pun ion alighted from a train, while returniugfrom Delphos, she was left alone at tlie Middle Point depot. That the hour Ueiug near midnight Hiest decided it would be dangerous for her to go through town unattended and for this reason he accompanied her. On the way he slipped from a walk, which stand about a foot above the level of the ground, and in an effort to regain his balance be grabbed the girl and she too fell to the ground.
