et30eoIn the Rio Grande Valley ana had as their guests Sunday, Mr. and Mrs. Kenneth Sessions.DEATH SENTENCE OF JOHNNIE BANKS AFFIRMED BY COURTDEATH SENTENCE OF HARRY LACY WAS REVERSED AND REMANDEDAUSTIN, Dec. 15.—f/P)—Thc| court of criminal appeals today affirmed one death case and reversed and remanded one.The death sentence of Johnnie Banks, given in Brazoria county for the fatal shooting Aug. 10, x 3936, of Jewel Smith, was affirmed, That of Harry Lacy, inflicted in Trinity county for the slaying Deo. 13, 1035, of Edgar Womack, was reversed and remanded.The court reversed the Lacy case because of improper testimony at the trial. It noted that Lacy, a negro, had asked for a change of venue from Grimes county, which had been denied, but said the motion had not been adequately supported.The killing was the outgrowth of the theft of a hog from Womack in Trinity county. Womack was shot soon after he found the hog about to be dressed.Lacy admitted the killing, but said he wag compelled to do it under threat from Bosie Beasley, whom he accused of the hog theft.At the trial Beasley was permitted to testify he had nothing to do either with the theft or the killing and also that grand juries in Trinity county had not indicted him.Testmony Prejudicial.'
