E. Graham, Dr. Andrew F. Giesen, Dr. H. U. Heart well, W. C. Ratcliffe, Deputy Andrew Smith and Deputy Russell Cline.During the testimony of Deputy Ratcliffe, it was brought out that King called him after the shooting and told him to come and get him, that he had shot Mr. and Mrs. Wirt.Deputy Ratcliffe told the court that King explained how the shooting took place. According to Ratcliffe, King' was walking on state route 624 west of Radford ©n the right side of the road and met Mr. and Mrs. Wirt coming east on their right, jiving said Wirt stopped when he was about 12 feet from him and picked up a rock and told him he was going to “get him.At this time King, Deputy Ratcliffe stated, took out his gun, which he claimed he had a permit to carry because of his job with the state highway department, and fired at Wirt. Wirt then started running and he continuedto fire.Deputy Ratcliffe explained that King claimed he did not know Mrs. Wirt had been shot until she said, “Stop shooting you have hit me. He said King then started toward his home and looked back and saw Mr. Wirt walking down the road with Mrs. Wirt leaning on his shoulder. He then went home and called the deputy to come and get him, it was told.Deputies Smith and Cline testified to essentially the same story that Ratcliffe did.Dr. Giesen stated the cause of Mrs. Wirt’s death was due to a bullet penetrating her left chest and going through her lung, causing it to deflate. The bullet came out below her shoulder blade. The doctor also said Mrs. Wirt was suffering from shock. She died on the morning of July 6—one day after the shooting—at 4:25 a. m.Saw King Afterwards Mr. Mitchell testified he passedKing about 200 yards from the place of the shooting a few minutes after it occured and Kingdid not say anything about it. He stated he went up the road and found JMrs. Wirt lying in the ditch face down and went to getsome help.
