Waller Fined, Given2 Years’ Probation; Two Charges DroppedDonald W. (Scotty) Waller, Honesdale RD2, was fined $200, ordered to pay costs of prosecution on three charges, and placed on two years’ probation to Probation Officer Janies Burns Friday afternoon by Judge James Rutherford.Judge Rutherford also granted the petition of District Attorney David M. Boyd for nolle prosse (withdrawal of prosecution) of avo felonies, solicitation to commit sodomy and sodomy. Waller’s attorney filed a writ of nolle contendra (claimed no defense) to a misdemeanor, corrupting the morals of children.In his writ of nolle prosse. District Attorney Boyd atated that the “three charges arise out of substantially identical transactions or series of transactions involving substantially the same persons.”The alleged offenses against minors involved four boys, ages 14 and 15, and were* committed between October 1, 1968 and January 31, 1969.
